“Donald Trump on Thursday sued his rival in the 2016 U.S. presidential election, Hillary Clinton, and several other Democrats, alleging that they tried to rig that election by tying his campaign to Russia.
The lawsuit covers a long list of grievances the Republican former president repeatedly aired during his four years in the White House after beating Clinton, and comes as he continues to claim that his 2020 election defeat by Democratic President Joe Biden was the result of widespread fraud.
“Acting in concert, the Defendants maliciously conspired to weave a false narrative that their Republican opponent, Donald J. Trump, was colluding with a hostile foreign sovereignty,” the former president alleged in a 108-page lawsuit filed in a federal court in Florida.
The suit alleges “racketeering” and a “conspiracy to commit injurious falsehood,” among other claims.
The suit seeks compensatory and punitive damages. Trump said he was “forced to incur expenses in an amount to be determined at trial, but known to be in excess of twenty-four million dollars ($24,000,000) and continuing to accrue, in the form of defense costs, legal fees, and related expenses.”
The defendants in Trump’s lawsuit include Christopher Steele, a former British intelligence officer.”

I read Trump’s “Art of the Deal” right when it came out. I was for a long time an admirer of Donal Trump. I remember roughly a passage from the book where he talked about getting dressed in business attire right after breakfast in the early AM, because you never knew when an important call might come in, and you had to be ready with an “office presence” to handle that call. When he was accused of being “undisciplined…” I had to laugh. I’ve also accused Trump of being a fake. And, I’m not necessarily backing away from that, but GD he has every right to go after these …….. and nobody better than a real estate devleloper and casino owner from New York. !!!

Pat, that was Trump’s point exactly about justice being trumped by politics. Trump and I are the same age, he grew up in Queens and I in Yonkers. B/y that the circumstances of our lives were very different. But you could not be a NY’er and not follow Trump. What a self indulgent wind bag who never had the common sense to just shut up. I still think that. But boy oh boy do we need such a fighter today. I’d even suggest a fushion ticket and put Gabbard on as V.P. candidate. Yes, I’ve come a long way about her. I’m uncertain of the politics of that but at least we would have a ticket of patriots. That seems much to ask for today. But I think we could both vote for that.

BLUF:
1. “Move over Durham” indeed. It’s a sign that Durham is going nowhere, because if he was, why file this lawsuit? Durham would be charging most of these things.
2. The lawsuit will run into the First Amendment like a Corvair running into a granite wall at 120mph.
3. First Amendment aside, the facts pleaded are insufficient to implicate most of the defendants, eg Hillary or establish a RICO conspiracy.

Going through the alleged facts, I saw a whole lot of “So what?” and emotionally loaded language.
Pleading that something is false is not proof something is false.
Pleading that someone knew something was false is not proof someone knew something was false.
Many of those facts in the complaint are unprovable. “Facts” in the legal pleading sense, not the common use of the word.
“Proprietary and non-public” do a lot of work with regard to the Alfa Bank server connection. This DNS data is a backbone of a lot of commercial data mining.
Yes, Sussman and Danchenko allegedly made false statements to the FBI. In the case of Sussman, astounding that a lawyer would trap himself in that way.

I don’t think the issue is whether it runs afoul of Durham. It will. The issue is whether there is any one brave enough to insist on justice. There won’t.

To bankrupt all the defendants as they will have to go to court to defend themselves. The discovery will be wonderful fodder for Trump’s new media enterprise.

None of these defendants will be bankrupted. The defenses will mostly be consolidated in a dismissal motion.
There will be no discovery if it’s dismissed in a Fed. Rule of Civil Procedure 12 motion.
I can see Durham being annoyed, as the lawsuit is preempting and maybe will end up discrediting his work by association, if he can do anything at all. Maybe that’s why it’s been filed – Trump knows Durham can’t do anything.

Pat you retain belief in the justice system. I don’t. Even if Trump wins his suit, so what? Someone in Florida will have to do something about it. Who will? Who is that one brave man beyond Trump? Perhaps its Durham. Durham is coming. So is Christmas, this year, or last year, or next year. We should finally open our eyes, Durham is just another “official” running out the clock. Can we

I am here to lead, not follow. I don’t know how much experience you have had of the judicial system. I have served on state petit juries and on a federal grand jury. After 9/11 I served as an expert witness and consultant to various federal district courts across the country. On the whole IMO the system functions well. The courts and juries did not always produce the result I wanted, but sometimes you eat the bear and sometimes the dear eats you. If Trump’s suit is not dismissed by the judge, the defendants will be smeared with their own s–t. That will be enough.
