RICO

"In this episode of Common Sense, Rudy Giuliani, who was the trailblazer for RICO prosecutions in the 1980s, demonstrates how the thirty years of the Biden Family selling public office, and many other crimes, makes a perfect RICO case."  RICO case

Rudy lays out a solid case in the video. I’d say damning. I like the cigar ad too!
Biden has gone silent for four days. He apparently won’t re-emerge until the debate Thursday. That’s what they say anyhow. How weird for this point in the election cycle! IMO, he will probably dodge the debate because he knows Trump will hit him hard with this material. I even think that at least one Biden will be leaving us, permanently, in the near future.
Just when I thought the media couldn’t defile themselves any further, they will sink to the bottom of the abyss of unethical behavior to try to save the Democrats. They must either accept defeat or go full on dictatorship, with all that implies. We are standing at the crossroads.

  2. Fred says:

The movement to discredit/disqualify any commentary on this story is intesifying. Biden’s cowering in the bunker and Obama’s bringing what’s left of his reputation to Philly. Lord knows who’ll attend that speech in person unless Covid, like in all the George Floyd events, is declared risk free for his appearance. The real polling numbers must be horrendously bad for the left.

  3. blue peacock says:

    Col. Lang,
What is your confidence that a second term Trump administration will bring those at the highest levels of government to account unlike the current Trump administration?
What do you believe will change in a second Trump administration? Will Trump hire once again the same types of people like Rosenstein, Wray, Kelley, Mattis, Bolton, Barr, et al?

  4. TV says:

    Does anyone care?
Sadly, a significant majority don’t know and don’t care.
Large numbers are driven by Trump derangement syndrome and a “belief” that America is a racist, sexist and generally evil place.
What happens to a country when its own citizenry turns against it?

  5. jstan says:

A RICO case is often a long, complicated, balls to the wall kinda case. I did prep work on such a case against the Tobacco Companies back in the day. I would prefer it be brought by a younger person. Rudy can be the guru on it. But better someone younger.

  6. BillWade says:

Things would get very interesting if Joe were to drop out this week. I hope Hunter is in “rehab” or such, I imagine there’s a big target on his back.
We went out for lunch today to a place a little out of the way. We drove through many residential areas. Biden, judging from yard signs, is doing far better than Clinton ever did but Trump signs are at least 6-7 to 1 for Biden.
Just watching various Trump campaign clips, he’s never been better at campaigning, thinking he knows he’s going to win.
    Clinton/Harris 2020!! NOT

If he wants to save us he must fire and prosecute all these people.

  8. Fred says:

    jstan,
Rudy is so far doing all of this as a private citizen, thus the FBI/DOJ sleepers haven’t sabotaged it. When Trump wins his second term look for the fur to fly.

  9. AK says:

    EN,
They must either accept defeat or go full on dictatorship, with all that implies. We are standing at the crossroads.
For these people, there is no accepting defeat. They are the intellectual caste who have been thoroughly indoctrinated through elite university education into the post-modern worldview of life and society as a Hobbesian power struggle and nothing more. They have no allegiance to any higher principles or ideals (hence their disdain for the traditional American culture of individual rights and freedoms). They certainly have no moral ethos that constrains their actions within any rule-based system (hence their disdain for traditional American Constitutional Law). At the very least, I think these people, the modern Democrat party included, would settle for titular rule over a version of the U.S. that is really just a hollowed out vassal state of the CCP. Many of the crazier ones (the real-deal Marxists) would rather rule over a mountain of corpses than not rule at all.

  10. elaine says:

Initially I thought why bother with a RICO indictment when the
Emolument’s Clause would suffice, however only Joe could be found
at fault under an Emolument violation, if a prosecutor wanted Hunter & Joe’s brother to also be held to account looks like RICO is the best path. I’m not holding my breath waiting for indictments.

  11. smoke says:

Guiliani makes a good lawyer’s argument still. YouTube obligingly follows that with Pam Bondi’s carefully detailed argument about Biden family corruption, which she presented to Congress at the impeachment trial. A month ago, the Senate Investigation’s report identified substantial fund transfers from Ukraine, Russia, and China to the Bidens, but it received scant attention. The emails put meat on the earlier bones.
Given all this, two questions come to mind:
    1) Why did Obama keep putting Biden at the head of these missions, where he accomplished little, even if his role was largely “in title” only?
    2) Why has Biden been the DNC’s preferred candidate? Surely they did their own research and knew all this already. Either it is a feature, not a glitch, or the DNC are as inept as they often appear, and they did not know. The latter seems impossible.

  13. robt willmann says:

The Racketeer Influenced and Corrupt Organizations law (RICO) dates back to the early 1970’s, and the primary author was Robert Blakey, who taught at Notre Dame Law School for many years. He is now ’emeritus’, and I think he has moved to Arizona. Since Supreme Court nominee Amy Coney Barrett taught at Notre Dame Law School since 2002, she would know Blakey.
RICO creates both a criminal action and a civil action. Some states have copied it or made their own versions of it as a state law.
The video of Rudy Giuliani talking about the Biden matter is a good one. There is another one of Steve Bannon talking to Giuliani, but it does not really add anything to the one Rudy did by himself.
The RICO law sat around and was not used very much until the 1980’s, when Giuliani started using it as a federal prosecutor in organized crime cases, which generated a lot of publicity.
Here is a 40-page article by Blakey and a co-author published in 1980 which discusses the history of the law and its parts. Like most such articles, it is pretty dry reading, but you can get a basic understanding of RICO after reading it. A lot of cases were appealed starting in the 1980’s which resulted in interpretations of the various parts of RICO, but its principles are still essentially the same.

Does anyone care? Yes we all care or should care as our country is at stake. What has been revealed in the last few days is a crime of large proportion in so far as this type of crime is most likely occurring in a number of political families. It tell us why Term Limits has never been legislated or why 70 and 80 year old politicians never leave office till they are carried out.
Joe Biden could not run his household thus how could he run a country. Yes, addiction is a disease but this boy has been to rehab over five times and most likely there tonight. Turns out that the FBI guy that picked up the laptop was assigned to the Child Exploitation Task Force. I sure hope this Q anon group was not correct.

  15. fakebot says:

    Sirs,
A word of caution, this happened before in the last election:
    https://www.breitbart.com/radio/2016/11/04/erik-prince-nypd-ready-make-arrests-weiner-case/

Prince claimed he had insider knowledge of the investigation that could help explain why FBI Director James Comey had to announce he was reopening the investigation into Clinton’s email server last week.
“Because of Weinergate and the sexting scandal, the NYPD started investigating it. Through a subpoena, through a warrant, they searched his laptop, and sure enough, found those 650,000 emails. They found way more stuff than just more information pertaining to the inappropriate sexting the guy was doing,” Prince claimed.
“They found State Department emails. They found a lot of other really damning criminal information, including money laundering, including the fact that Hillary went to this sex island with convicted pedophile Jeffrey Epstein. Bill Clinton went there more than 20 times. Hillary Clinton went there at least six times,” he said.
“The amount of garbage that they found in these emails, of criminal activity by Hillary, by her immediate circle, and even by other Democratic members of Congress was so disgusting they gave it to the FBI, and they said, ‘We’re going to go public with this if you don’t reopen the investigation and you don’t do the right thing with timely indictments,’” Prince explained.
“I believe – I know, and this is from a very well-placed source of mine at 1PP, One Police Plaza in New York – the NYPD wanted to do a press conference announcing the warrants and the additional arrests they were making in this investigation, and they’ve gotten huge pushback, to the point of coercion, from the Justice Department, with the Justice Department threatening to charge someone that had been unrelated in the accidental heart attack death of Eric Garner almost two years ago. That’s the level of pushback the Obama Justice Department is doing against actually seeking justice in the email and other related criminal matters,” Prince said.

And yet President Trump sat on all this when he took office, if we are to believe the founder of Blackwater (now Academi).
There is no question Hunter is a screw up and these emails could very well be as authentic as they are damning, but I think some skepticism is in order here. That picture of Hunter with the crack pipe in his mouth was taken while he was asleep. It looks like someone was trying to blackmail him, something I wouldn’t put past whatever web Mr. Bannon and Mr. Prince have possibly weaved here.

  16. fakebot says:

I don’t know what rabbit hole this laptop business is taking us into, but Paul Sperry wrote a very good report detailing how Hunter Biden was allowed to peddle his father’s influence while securing lucrative deals for himself.

  17. Deap says:

My suspicion is Biden will claim he needs to “spend more time with his family” and send Kamala Harris to “debate” Trump, since the debate commission just changed all the topics to best suit her agenda.
What should Trump do? Walk away. Google already admitted they bring up only negative articles if someone searches “Trump” and positive ones if they search “Biden”.
The Information Age is over. 1990-2020 – a sordid 30 year run. Leave social media to the high-tech addicted mop-up generation who has to both live with and clean up the mess left in its wake. So much promise; so much failure.

  18. Deap says:

Does anyone have friend on the Left who live only in the MSM echo chamber? Do they know anything about this story; other than it was “debunked” which is also backed up by a full Wikipedia denial.
We have such friends/relatives, but I dare not even ask – we have tacitly agreed to social distance all matters political.

  19. Deap says:

Veering off topic but should Trump- Fauci be soon facing a Truman -General McCarthy showdown moment? You’re fired!
It can wait until after the election is finalized, but not a moment longer. No matter which way the election goes.

  20. Diana L Croissant says:

I am left entirely sad after listening to this. What a terrible state our country’s politics are in at this point. And there are many powerful people doing their best to keep any knowledge of this sort of criminal activity from the public. Is there even time now as many people have voted already. While I know that I and several of my family members have already placed our completed ballots in a lock-box near us provided by our County Clerk and Recorder and that we have NOT voted for Biden, how many other people have already cast their ballots here into lock boxes and voted for Biden?
Truly our country is at a stage where the most we can do is pray fervently and continually. I am quite sad.

  21. BillWade says:

    TV, Charlotte County Florida.
This election will be the most voted, by percentage, since Abraham Lincoln in 1860. It was 81% back then and will be about 61% this election. I now suspect a Trump landslide.
Deap, my wife who is a Republican and who will vote for Trump thinks the media has successfully buried the Biden travails. So, likely the left leaning folks don’t think it matters. What a shame.

  22. Fred says:

    Deap,
“Does anyone have friend on the Left who live only in the MSM echo chamber?”
I know quite a few, they mostly haven’t heard and wouldn’t listen and many have already proudly voted the Donald out. I also know a few who have ‘Left’ the left behind; riots, BLM, NBA/NFL, “you’re racist” uncouncous bias b.s,. and Russia, Russia, Russia, +Ukraine all did them in, masks and the culture of fear being the final things that ‘woke’ them up. Given the number of under 60 New Yorkers and Pennsylvanias now down here in this part of FL I would say Joe’s in deep trouble, though thanks to Justice Roberts and the politicized court he may succeed in stealing PA since they are being given three days to manufacture votes after the polls close.

  25. JerseyJeffersonian says:

    Bobo,
I suspect, with sadness, that Qanon may have things gauged all too well. Imagine the frisson of evil power that such satanic people would enjoy if the accusations of child sexual abuse (and worse) were, indeed, true. Why would people such as these, who seem to derive sadistic pleasure from the destruction of entire nations and cultures, not wish to enjoy such feelings personally?
There is no internal or external let or stay on their skin-crawling corruption when they have the world wired to permit these things.
Given that state of affairs, Procopian levels of decadence and moral evil would eventuate almost inevitably in all areas of their lives.

The man’s got to be a shoo-in. Go long therapy dogs.

  27. Fred says:

    English,
You missed the recent supreme court decision, 4-4, upholding the lefty Pennsylvania Supreme Court’s stay of the 3 day post election non-post mark required ballot stuffing ruling. I take that to mean ACB will be confirmed next week and the decision looked at again before November 3rd.
