“The Biden administration sued Texas Friday in an effort to block an executive order allowing state troopers to stop vehicles suspected of carrying illegal immigrants on the grounds that they may be spreading COVID-19.

The lawsuit follows a letter from Attorney General Merrick Garland warning Texas Gov. Greg Abbott that the order, which the governor issued Wednesday, was both “dangerous” and “contrary to federal law.” The government’s legal filing argued that the order could obstruct federal immigration operations, including migrant transport.

Under Abbott’s order, the Texas Department of Public Safety can stop any private vehicle “upon reasonable suspicion” that it is carrying illegal immigrants. If the suspicion is confirmed, troopers could then reroute vehicles back to their point of origin or impound them.

In response to the lawsuit, Abbott claimed in a statement Friday that the Biden administration “has created a constitutional crisis between the federal government and the State of Texas” by “knowingly import[ing] COVID-19 into Texas from across the border—willfully exposing Texans and Americans alike.”

“President Biden has a duty and a responsibility to protect and uphold our nation’s sovereignty, yet he has long-since abdicated his authority to do so,” Abbott added. “As the Governor of Texas, I have a responsibility to protect the people of Texas—a responsibility that grows more urgent by the day while the Biden Administration sits on the sidelines.” nypost

Comment: ” abdicated his authority to do so” A better word would have been “responsibility.” Actually Abbott’s order is written to exclude official vehicles and vehicles under contract to the federal government. So, what are Biden and the Marxist gang going to do to make Garland’s lawsuit stick in Texas? Are they going to federalize the Texas NG? Are they going to order the Regular Army to emerge from places like Ft. Hood (name unchanged as yet) to occupy what was once the Republic of Texas. Will the FBI seek to arrest Governor Abbott? pl

    That loophole of not stopping official vehicles or vehicles under contract to the federal government gets both Abbot and Biden off the hook for a confrontation. All this amounts to the two of them doing the dozens in front of their respective gangs.

    So American citizens and any other ‘documented’ person needs covid testings, masks and ‘documents’ to travel but Garland and the rest of the Executive Branch can engage in “federal immigration operations, including migrant transport”.

    Nice to know we are seperate and decidedly unequal in our own country.
    Where is “lying” Ted Cruz and “Little Marco” Rubio and their House Colleagues, starting with Frank Luntz’s roomie, the minority leader?

      Why not frame it like the slave laws imposed on non-slave holding states? Why should states that object to people without documentation have to accommodate them? In the past immigrants had to show they were not infected with tuberculosis and HIV to come into the US.

        Being counted in the census without having to show you are a citizen puts the population count up 22+ million. That’s about 25 congressional seats outright. No pesky “three fifths” math to get in the way of your gerrymandering via illegal entry into the US. There’s a giant industry living off federal largess aiding all those people too.

    Kayfabe, as they say about professional wrasslin’. Not a good look Governor; do you stand for legitimate governance of the Republic or not?

    Nullification sounds pretty good to me when some group of idealogues such as the “open borders” gang gets the bit between their teeth and tries to run away with the Republic. Which is exactly what they are trying to get away with right now through these actions, trashing the Chief Magistrate’s responsibility to enforce the law as it is. He and his “open borders” gang want to change the law? Let them try, and see where they get.

    When the jumped up Executive tramples all over the security of the nation, ignoring the law as they are, they need to be smacked down comprehensively. Rather like Andrew Jackson did to the Judiciary when the Supreme Court tried to tell him to stand down when he instituted the Cherokee removal. It was certainly not a pretty picture, but Jackson held fast to his “responsibility” for protection of the national security as he saw it, and ignored the Supreme Court as having no authority to tread over into his authority as the Executive. To his credit, he didn’t just sit there passively as Madison did when John Marshall, the Federalist idealogue, did with the Madison v. Marbury travesty, a decision aimed at making it impossible for the Executive to control his branch’s personnel, obligating the Executive to put up with embedded “stay behind” partisans acting against the Executive’s right to implement his own policies.

    And haven’t we just had an object lesson in what that leads to during the Trump administation ? With that beachhead against the rule of law secured, they now have moved on to more and more selective enforcement of black letter law, as here with the “open borders” horror. They stole the election for the only directly elected Federal posts, those of President and Vice President, abrogating the right of the citizens of the constituent States of the Republic to designate their choice of the head of the Executive branch through a legal election (i.e., one following the Constitutional procedures stipulated). How is this not already a tyranny? What more proof do we need ? And now they want to rub our faces in it by ignoring enforcement of the statutes enacted by the legislative process when it suits their ideological purposes?

    What if Governor Abbot is kindly asking the DOJ to do their dirty works in federal vehicles…or cut him in…or do whatever you’re doing in your own vehicles signaling? I know it may sound a bit outrageous but why would Abbott-as you mentioned- invoke “private” and not ‘any vehicle of suspicious activities’ to really send the message of non-interference with the state law to the DOJ?

    Had Biden et al. declared the pandemic over, put away the masks, shut up about the vaccinations—and just let us alone, the Texas governor would be out in left field.

    Garland’s letter told Abbott about the constitution and federals laws etc.

    However, Abbott issued an Executive Order — essentially declaring a public health/aka COVID-19 public health emergency.

    “I have the authority, and duty, under the constitutions of the United States and of Texas to protect Texans and our nation. I also have the authority under long-established emergency response laws to control the movement of people to better contain the spread of a disaster, such as those known to have COVID-19.”

    This is Abbott’s riposte to Garland and Biden.

    In other words: Abbott is shoveling the Biden Covid-19 Horse Shit right back in his face via the AG, Garland.

    The gov. is saying: Two can play this Covid-19 Fear Mongering Game.

    Biden can end this fiasco by declaring the pandemic over, declare there is no public health crisis, etc etc.

    This would take the legs right out from under Abbott.

    Abbott knows Biden is too invested in the corona-fear-control-the population-sweepstakes to act in this sort of rational manner.

    Which in a way provide this spectacle a lovely little frame of black humor, actually.

    Abbott is exposing the contradictions in the Biden team’s lust for power.

    If the feds can claim authority to what ever in the hell they want in the name of “covid covid covid danger danger danger” —- well, Abbott just threw a big wet juicy and ugly reality slap at Garland and Biden.

    Abbott’s state of Texas gubernatorial executive order, in this context: is mimicry–and mockery– of the federal government’s own obscene power grabs.

    If COVID-19 is the grandiose and never ending catastrophe Biden at al. claim; then he and his AG have to shut up and put up with Abbott.

    This morality play if nothing else will force the DOJ etc. to either operate on the basis of science and reason and logic — and thus end the COVID shenanigans once and for all; or: this chaos will take other new and novel twists and turns, — and Biden et al. will have no choice but to stand there with their pants down. They are the idiots that created the conditions for this spectacle. They are being battered and gob-smacked by their own hysteria on covid. Good!
